Canon 1340

1. Unless particular law of a Church sui iuris determines

otherwise, the eparchial bishop of the eparchy in which the first

instance sentence was rendered, must execute the sentence personally or through another. 2. If he refuses or neglects to do

so, the execution belongs to the authority to which the appellate

tribunal is subject, at the request of an interested party or ex

officio. 3. In cases of can. 1069, 1 the execution of a sentence belongs to the superior determined by the statutes or

typicon.
