Canon 1373

1. If the defender of the bond prudently thinks that either the

flaws mentioned in can. 1372, 1 or the lack of a dispensation

are not certain, the defender of the bond must appeal against

this declaration to the judge of second instance, to whom the

acts must be sent and who must be advised in writing that it is a

question of a documentary process. 2. The party who feels aggrieved retains the right to appeal.
