Canon 1379

1. Unless one party seeks an ordinary contentious process, a

summary contentious process is to be used. 2. If the ordinary

contentious process has been used and an appeal is proposed, the

appellate tribunal, after hearing the parties, is to proceed by

its decree whether to confirm the decision or admit the case to

an ordinary examination in the second degree.
