1. Notwithstanding the reasons alleged, if the eparchial bishop judges that he is not going to change his plans, he is to discuss the reasons which favor or oppose the transfer with the two pastors chosen in accordance with can. 1391, 1; if he then decides to implement the transfer, he is to repeat the paternal exhortations to the pastor. 2. When this has been done, if the pastor still refuses and the eparchial bishop thinks the transfer must be made, he is to issue a decree of transfer stating that the parish shall be vacant after the lapse of a predetermined time. 3. If this period of time has passed in vain, the eparchial bishop is to declare the parish vacant.
