1. It pertains to the eparchial bishop to convoke the presbyteral council, to preside over it and to determine the questions to be treated by it or to receive proposals from members. 2. The eparchial bishop is to hear the presbyteral council in matters of greater importance and in cases expressly determined by common law he must consult them; however he needs its consent only in cases expressly determined by common law with due regard for the right of the patriarch regarding matters of the eparchy which he himself governs, in these cases the presbyteral council need only be consulted. 3. The presbyteral council can never act without the eparchial bishop, who alone can divulge those things which have been done in the council itself.
