Canon 363

The following cannot validly enroll a cleric in an eparchy, dismiss him from it, or grant permission to the cleric to move outside of it: (1) the administrator of the patriarchal Church,

without the consent of the permanent synod; the patriarchal exarch and the administrator of an eparchy without the consent of

the patriarch; (2) in other cases, the administrator of an eparchy, unless the eparchial see has been vacant for a year, and

then only with the consent of the college of eparchial consultors.
