Canon 435

1. The eparchial bishop is competent to erect a monastery sui

iuris, having consulted the patriarch within the territorial

boundaries of the patriarchal Church, or, in other instances, the

Apostolic See. 2. It is reserved to the patriarch to erect a

stauropegial monastery.
