1. An order or congregation cannot validly erect a house without the written consent of the eparchial bishop. If it is the case of erecting the first house of an order or congregation of patriarchal right in some eparchy, the consent of the patriarch is required within the territorial boundaries of the patriarchal Church, or in other cases, the consent of the Apostolic See. 2. The matters mentioned in can. 437 shall apply also to houses of orders and congregations.
