Canon 940

1. In order to be promoted to an office, a person must be suitable, that is, endowed with those qualities which are required by

law. 2. When the person promoted to the office lacks the required qualities, the provision is null only if this is provided

in the law; otherwise it is valid, but it can be rescinded by a

decree of the competent authority which must act observing

equity.
