Canon 1163

1. Whenever a petition is introduced to obtain provision for

the support of a person, the judge, having heard the parties, may

determine, by a decree to be executed immediately, after having

specified any opportune precautions to be observed, that in the

meantime the necessary maintenance is provided, without prejudice

to the law to be defined by the sentence. 2. Whenever a petition has been presented by a party or by the promoter of justice

to obtain this decree, the judge, after having heard the other

party, shall provide for it most expeditiously, never beyond a

ten day period; after such time, or if the petition is rejected,

recourse is available to the authority to whom the tribunal is

immediately subject, provided that such authority is not the

judge himself, or, if a person prefers, to the appellate judge

who likewise shall determine the matter most expeditiously.
