1. If the arbitrators are not designated in the compromise document or if there is to be a substitution, and the parties or others to whom the designation is entrusted disagree regarding all or some of the persons chosen, any party may entrust the matter to the tribunal that is competent to decide the case in first instance, unless the parties have agreed otherwise; after having heard the other parties, the tribunal is to provide by decree for the selection. 2.
