Canon 1174

1. If the arbitrators are not designated in the compromise

document or if there is to be a substitution, and the parties or

others to whom the designation is entrusted disagree regarding

all or some of the persons chosen, any party may entrust the

matter to the tribunal that is competent to decide the case in

first instance, unless the parties have agreed otherwise; after

having heard the other parties, the tribunal is to provide by

decree for the selection. 2. The same norm is to be observed

if one or other of the parties neglected to designate an arbitrator, provided that the party which brings the matter to the

tribunal which designated the arbitrators, if it was to do so, at

least twenty days beforehand.
