Canon 1278

Unless the innovation is accepted by the law itself, an attempt

is the act, while a suit is pending, whereby something is introduced prejudicial to one party who does not agree either on the

matter of litigation or on the procedural rights. Such an attempt may be introduced by one party against another or by a

judge against one of the parties or against both.
